transmission slipping in OD at 40mph

Hello, Trying to find out if this is something to worry about, I have a 2010 CV with 81k miles and (9400Hours)
The transmission shifts fine and holds fine at WOT,
Even at highway speeds OD is fine, but when it shifts in at 40 and i give it more throttle, i can feel it slipping, but once i hit 50 its fine,
Is it anything to be concern about?
(my OD switch doesnt work)

forgot to add there is no check engine light on

Transmission slippage that can be felt is BAD, you need to determine the cause and correct it...

How can you determine it's gear slipping and not that torque converter lock opens? That's what my car does. Torque converter is locked at 40 mph if I'm gentle with throttle. If I give more throttle lock opens. That's how it should work I think.

well, it is almost like your going over small bumps in the road and makes a little squeaking noise,
The fluid seems to be over filled by about 2"
Would dropping the pan and changing the fluid filter be worth it or just a waste of money at this point?

it is almost like your going over small bumps in the road That sounds just like the infamous torque converter clutch shudder. The fluid seems to be over filled by about 2" Well, that's wrong to start with. Definitely drop the pan, change the filter, and refill with the proper quantity of Mercon V. Be advised that if it IS TCC shudder, it may take a few miles of driving for it to subside after the change.
